The Supreme Court Just Changed the Broker-Carrier Relationship Forever

BCS Freight NetworkMay 14, 2026

The Supreme Court’s unanimous ruling in Montgomery v. Caribe Transport II, LLC could fundamentally change how freight brokers and carriers work together moving forward. As carrier selection practices face more scrutiny, strong partnerships, communication, and trust may become more important than ever across the freight industry.

The Supreme Court handed the freight industry a major wake-up call today.

In a unanimous 9-0 decision in Montgomery v. Caribe Transport II, LLC, the Court ruled that freight brokers can be sued for negligent carrier selection. The federal preemption protection that many brokers relied on under the FAAAA no longer blocks these types of state safety claims. That changes the conversation immediately.

For years, a large part of the industry operated with a transactional mindset. Cover the load. Move the freight. Find capacity fast and keep things rolling. The relationship between brokers and carriers often started and ended with a rate confirmation.

Now there’s far more attention on who brokers choose to work with and whether those decisions can hold up under scrutiny later.

The Industry Is Entering a Different Era

This ruling doesn't mean brokers automatically become liable anytime there’s an accident involving a carrier.

What it does mean is that carrier selection practices are going to matter much more moving forward. Safety records, operational history, inspection data, authority age, and internal vetting processes are all going to become more important parts of the conversation.

In general, the industry is moving toward a world where brokers need to know far more about the carriers they work with than simply whether authority is active. That’s going to force a lot of companies to rethink how they build carrier networks and how well they truly know the people they’re doing business with.

Relationships Are About to Matter More Than Ever

This decision will likely create a clear separation in the market. Some companies will continue operating exactly the way they always have, chasing the fastest or cheapest option available every single time. Others will lean harder into building long-term relationships with trusted partners they know well and communicate with consistently.

The second group is going to have a massive advantage.

Brokers who have invested time into building dependable carrier networks already understand the value of trust, transparency, and communication. Carriers who prioritize professionalism, safety, and consistency are going to become even more valuable partners in this environment.

Freight has spent years acting like brokers and carriers are on opposite sides of the table. This ruling is a reminder that both sides are tied together more than ever now.

What Smart Companies Are Probably Reviewing Right Now

Another push that will likely come of this is that carrier vetting will be much closer to the center of operations for brokers across the country. That includes things like:

  • Reviewing carrier safety data more consistently
  • Documenting vetting and onboarding processes
  • Keeping stronger records on carrier decisions
  • Building more dependable long-term carrier networks
  • Looking beyond price alone when covering freight

The companies with strong processes and real partnerships are going to be in a much better position than the companies built entirely around transactional freight.

Why This Matters to the BCS Freight Network

Broker-Carrier Summit Founder and President, Dan Lindsey, put it best after the ruling:

“Massive news out of DC…the relationship between freight brokers and their carriers will fundamentally change. What won’t change? The importance of partnerships between the two.
In fact, partnerships have just become exponentially more important… Brokers, you need to know your carriers even better than before. Carriers, you also need to get to know your brokers.”

That mindset is exactly why the Broker-Carrier Summit and BCS Freight Network exist.

The industry is changing whether companies are ready or not. The brokers and carriers who already know each other, trust each other, and work together consistently are going to be in a far stronger position moving forward.
